THE THESIS
REWOOD is not a fee schedule. It is a regulatory ban with criminal procurement liability. Insurance does not cover criminal violation. The procurement documentation that protects your firm in 2029 takes 18 to 24 months to build — meaning the firms that begin in May 2026 will pre-qualify for major work in 2028, and the firms that wait until 2028 will be retrofitting under deadline pressure. T-32 months and counting.
What REWOOD actually does
Ontario's REWOOD framework (Resource Recovery & Circular Economy Act regulations, scheduled for full activation January 1, 2029) makes it a regulatory violation to dispose of clean wood waste in landfill. Three things make this fundamentally different from the CIRCIL Levy escalation discussed in our prior posts:
- The mechanism is criminal regulatory, not financial. CIRCIL is a fee. REWOOD is a ban.
- Liability transfers from the disposal vendor to the firm generating the waste. The general contractor's procurement director carries personal liability for procurement decisions made between 2026 and 2028 if those decisions result in clean wood entering landfill after January 1, 2029.
- Insurance does not cover criminal regulatory violation. The standard Errors & Omissions policy explicitly excludes regulatory enforcement actions.
The compounding stack
REWOOD does not arrive in isolation. It activates inside a stack of three Ontario-side regulations that compound rather than substitute:
- REWOOD ban (Jan 1, 2029) — criminal violation for landfill of clean wood.
- CIRCIL Levy escalation — by 2029, the spread between clean and mixed classification reaches $383 per Mothership. By 2032, $575. By 2036, $958.
- Capacity Cliff (2034) — Ontario landfill capacity exhausts. Spot disposal pricing escalates. Cross-border alternatives become economically punitive.
A general contractor running mixed loads in 2032 faces a tri-fold cost stack of roughly $90+ per tonne over today's mixed-disposal baseline — before any criminal exposure. What R²P (REWOOD Readiness Predictor) does
905WOOD's R²P is a customer-specific risk scorer for the 2029 ban. The audit deliverable

Why timing matters
The naive instinct is to wait until the REWOOD final rule publishes in late 2027 before commissioning an audit. Three reasons not to:
- Procurement documentation built between now and late 2027 builds your firm's defensible posture. The procurement decisions you are making in 2026 will be examined under the 2029 enforcement microscope.
- R²P methodology pinning means an audit done today against the draft framework remains defensible after the final rule lands. The methodology version is locked to the issuance date.
